3. Przy ocenie nadmierności kosztów dla przedsiębiorcy uwzględnia się wszelkie okoliczności sprawy, w szczególności znaczenie braku zgodności treści cyfrowej lub usługi cyfrowej z umową oraz wartość treści cyfrowej lub usługi cyfrowej zgodnych z umową.
