1. Towar jest zgodny z umową, jeżeli zgodne z umową pozostają w szczególności jego:
1) opis, rodzaj, ilość, jakość, kompletność i funkcjonalność, a w odniesieniu do towarów z elementami cyfrowymi – również kompatybilność, interoperacyjność i dostępność aktualizacji;
2) przydatność do szczególnego celu, do którego jest potrzebny konsumentowi, o którym konsument powiadomił przedsiębiorcę najpóźniej w chwili zawarcia umowy i który przedsiębiorca zaakceptował.
