1. W przypadku sprzedaży nieruchomości rolnej prawo pierwokupu przysługuje z mocy ustawy jej dzierżawcy, jeżeli:

1) umowa dzierżawy została zawarta w formie pisemnej i ma datę pewną oraz była wykonywana co najmniej przez 3 lata, licząc od tej daty, oraz

2) nabywana nieruchomość rolna wchodzi w skład gospodarstwa rodzinnego dzierżawcy.
