5. Obowiązku, o którym mowa w ust. 1, nie stosuje się do:

1) nieruchomości rolnej nabytej przez Skarb Państwa lub jednostkę samorządu terytorialnego;

2) wchodzących w skład nabytej nieruchomości rolnej gruntów objętych umową dzierżawy opatrzoną przed dniem 30 kwietnia 2016 r. datą pewną – przez okres obowiązywania tej umowy;

3) budynku mieszkalnego wraz z gruntami, których powierzchnia użytków rolnych jest mniejsza niż 1 ha – obciążonych służebnością dożywotniego zamieszkiwania i użytkowania.
