Art. 1a. Przepisów ustawy nie stosuje się do:

1) nieruchomości rolnych:

a) wchodzących w skład Zasobu Własności Rolnej Skarbu Państwa, o którym mowa w ustawie z dnia 19 października 1991 r. o gospodarowaniu nieruchomościami rolnymi Skarbu Państwa (Dz. U. z 2025 r. poz. 826 oraz z 2026 r. poz. 318 i 815),

b) w których powierzchnia użytków rolnych jest mniejsza niż 0,3 ha,

c) będących drogami wewnętrznymi,

d) sprzedanych na podstawie art. 42 ust. 1 lub 6 ustawy z dnia 19 października 1991 r. o gospodarowaniu nieruchomościami rolnymi Skarbu Państwa,

e) w których grunty, oznaczone w ewidencji gruntów i budynków jako grunty pod stawami, stanowią co najmniej 70 % powierzchni nieruchomości,

f) nabytych na podstawie art. 6 ustawy z dnia 24 lutego 1989 r. o zmianie ustawy o ubezpieczeniu społecznym rolników indywidualnych i członków ich rodzin oraz o zmianie ustawy o podatku rolnym (Dz. U. poz. 53);

2) udziałów we współwłasności nieruchomości, o których mowa w pkt 1.
