8. W przypadku gdy podmiotem wykreślonym z Rejestru jest spółdzielnia mieszkaniowa z chwilą nabycia przez Skarb Państwa jej mienia spółdzielcze lokatorskie prawo do lokalu mieszkalnego przekształca się w prawo najmu podlegające przepisom ustawy z dnia 21 czerwca 2001 r. o ochronie praw lokatorów, mieszkaniowym zasobie gminy i o zmianie Kodeksu cywilnego (Dz. U. z 2023 r. poz. 725), a spółdzielcze własnościowe prawo do lokalu przekształca się w prawo odrębnej własności lokalu lub we własność domu jednorodzinnego.
