7. Operator wyznaczony odpowiada za niewykonanie lub nienależyte wykonanie publicznej usługi rejestrowanego doręczenia elektronicznego lub publicznej usługi hybrydowej w zakresie określonym ustawą, chyba że niewykonanie lub nienależyte jej wykonanie:

1) jest następstwem czynu niedozwolonego;

2) nastąpiło z winy umyślnej operatora wyznaczonego;

3) jest wynikiem rażącego niedbalstwa operatora wyznaczonego.
