3. Doręczenia w sposób wskazany w ust. 1 podmiotowi niepublicznemu dokonuje się po uzyskaniu przez organ procesowy jego zgody wyrażonej w tym postępowaniu. Uzyskana zgoda odnosi skutek procesowy tylko przed organem, przed którym została złożona. Przed odebraniem oświadczenia o wyrażeniu zgody albo o braku takiej zgody podmiot ten należy pouczyć o skutkach procesowych wyrażenia zgody albo jej braku.
