9. Na postanowienie, o którym mowa w ust. 7 pkt 2, przedsiębiorcy przysługuje zażalenie w terminie 3 dni od dnia doręczenia postanowienia. Właściwy organ rozpatruje zażalenie w terminie 7 dni od dnia jego wniesienia oraz wydaje postanowienie o:

1) utrzymaniu w mocy zaskarżonego postanowienia;

2) uchyleniu zaskarżonego postanowienia i odstąpieniu od czynności kontrolnych.
