2. Podjęcie czynności kontrolnych po okazaniu legitymacji służbowej, na podstawie odrębnych przepisów, może dotyczyć jedynie przypadków, gdy czynności kontrolne są niezbędne dla przeciwdziałania popełnieniu przestępstwa lub wykroczenia, przeciwdziałania popełnieniu przestępstwa skarbowego lub wykroczenia skarbowego lub zabezpieczenia dowodów jego popełnienia, a także gdy przeprowadzenie kontroli jest uzasadnione bezpośrednim zagrożeniem życia, zdrowia lub środowiska.
