10. W przypadku nieobecności przedsiębiorcy lub osoby przez niego upoważnionej czynności kontrolne mogą być wszczęte po okazaniu legitymacji służbowej pracownikowi przedsiębiorcy lub osobie zatrudnionej u przedsiębiorcy w ramach innego stosunku prawnego, którzy mogą być uznani za osobę, o której mowa w art. 97 ustawy z dnia 23 kwietnia 1964 r. – Kodeks cywilny (Dz. U. z 2025 r. poz. 1071 i 1172), lub w obecności przywołanego świadka, którym powinien być funkcjonariusz publiczny, niebędący jednak pracownikiem organu przeprowadzającego kontrolę.
