2. Przepisu ust. 1 nie stosuje się do przedsiębiorcy, który nie ma obowiązku prowadzenia ewidencji sprzedaży przy zastosowaniu kas rejestrujących, o których mowa w ustawie z dnia 11 marca 2004 r. o podatku od towarów i usług (Dz. U. z 2025 r. poz. 775, 894, 896 i 1203).
