1b. W drodze postanowienia wojewoda odstępuje od wymierzenia kary, o której mowa w ust. 1a, w przypadku gdy gmina wykaże, że przystąpiła niezwłocznie do realizacji obowiązku wynikającego z art. 95 ust. 3 albo ust. 4, lecz z przyczyn od niej niezależnych zachowanie terminu, o którym mowa w art. 95 ust. 3 albo ust. 4, nie było możliwe.
