4. W przypadku wszczęcia postępowania, o którym mowa w art. 94a ust. 1, termin na uwzględnienie w planie ogólnym oraz w miejscowym planie zagospodarowania przestrzennego występowania udokumentowanych złóż kopalin wynosi:

1) rok od dnia doręczenia właściwemu organowi wykonawczemu gminy kopii decyzji:

a) o uznaniu złoża kopaliny albo jego części za złoże strategiczne,

b) o której mowa w art. 94a ust. 13, w przypadku złóż węglowodorów;

2) 2 lata od dnia doręczenia właściwemu organowi wykonawczemu gminy kopii decyzji, o której mowa w art. 94a ust. 13, w przypadku złóż kopalin innych niż wymienione w pkt 1 lit. b.
