1b. Zmiana koncesji na poszukiwanie i rozpoznawanie złóż węglowodorów oraz wydobywanie węglowodorów ze złóż, a także koncesji na wydobywanie węglowodorów ze złóż, w przypadku, o którym mowa w ust. 1a, może nastąpić na wniosek przedsiębiorcy, jeżeli obszar, którego wniosek dotyczy, nie jest objęty aktualnym ogłoszeniem, o którym mowa w art. 49f ust. 1, albo nie zostało wszczęte postępowanie przetargowe dotyczące tego obszaru, albo nie został złożony wniosek, o którym mowa w art. 49e, albo obszar nie jest objęty inną koncesją na działalność polegającą na poszukiwaniu, rozpoznawaniu lub wydobywaniu węglowodorów.
