3. W przypadku gdy w wyniku oceny ofert zgodnie z kryteriami, o których mowa w ust. 1, dwie lub więcej ofert uzyskają jednakową ocenę, dodatkowym kryterium w celu dokonania ostatecznego wyboru między tymi ofertami jest wysokość wynagrodzenia za ustanowienie użytkowania górniczego, należnego w fazie poszukiwania i rozpoznawania.
