3. Jeżeli nie istnieje przedsiębiorca, obowiązki określone w ust. 1 wykonuje jego następca prawny, a jeżeli nie istnieje przedsiębiorca oraz jego następca prawny – obowiązki określone w ust. 1 wykonuje właściciel lub osoba posiadająca inny niż własność tytuł prawny do nieruchomości. W przypadku potrzeby osobę obowiązaną oraz zakres i sposób wykonania obowiązków określonych w ust. 1 ustala, w drodze decyzji, organ koncesyjny.
