1. Cofnięcie koncesji, jej wygaśnięcie lub utrata jej mocy, bez względu na przyczynę, nie zwalnia dotychczasowego przedsiębiorcy z wykonania obowiązków dotyczących ochrony środowiska i likwidacji zakładu górniczego albo zakładu, z uwzględnieniem ust. 1a oraz art. 39a ust. 1.
