8. Organ koncesyjny w terminie 60 dni od dnia otrzymania zgłoszenia, o którym mowa w ust. 1, z uwzględnieniem ust. 6, w drodze decyzji, zgłasza sprzeciw do skutku czynności, o których mowa w ust. 1, w zakresie przejścia koncesji, jeżeli:
1) nie zostały spełnione wymogi formalne, o których mowa w ust. 1 lub 3;
2) podmiot przejmujący nie wykazał spełnienia warunków, o których mowa w ust. 3 pkt 1 lub 4;
3) sprzeciwia się temu interes publiczny, w szczególności związany z bezpieczeństwem państwa lub ochroną środowiska, w tym z racjonalną gospodarką złożami kopalin.
