3. Organ koncesyjny może odmówić udzielenia koncesji, w przypadku gdy wydano decyzję o stwierdzeniu niedopuszczalności wykonywania praw z udziałów albo akcji przedsiębiorcy, na podstawie przepisów ustawy z dnia 24 lipca 2015 r. o kontroli niektórych inwestycji (Dz. U. z 2024 r. poz. 1459 oraz z 2025 r. poz. 973), jeżeli jest to w interesie publicznym, w szczególności związanym z bezpieczeństwem państwa lub ochroną środowiska w tym z racjonalną gospodarką złożami kopalin.
