Art. 189a.

1. W sprawach o wykroczenia, o których mowa w niniejszym dziale, organom nadzoru górniczego przysługują uprawnienia oskarżyciela publicznego w rozumieniu przepisów ustawy z dnia 24 sierpnia 2001 r. – Kodeks postępowania w sprawach o wykroczenia.

2. Uprawnienia oskarżyciela publicznego przysługują także wtedy, gdy wniosek o ukaranie za wykroczenia, o których mowa w niniejszym dziale, złożył inny uprawniony oskarżyciel.
