5. Podmiot jest obowiązany do dostarczenia Prezesowi Wyższego Urzędu Górniczego na każde jego żądanie, w terminie 30 dni od dnia otrzymania żądania, danych niezbędnych do określenia podstawy wymiaru kary pieniężnej. W przypadku niedostarczenia danych lub gdy dostarczone dane uniemożliwiają ustalenie podstawy wymiaru kary, Prezes Wyższego Urzędu Górniczego może ustalić podstawę wymiaru kary pieniężnej w sposób szacunkowy, niemniejszą jednak niż:

1) kwota 500 000 zł – w przypadku, o którym mowa w ust. 3 pkt 1;

2) kwota 5000 zł – w przypadku, o którym mowa w ust. 3 pkt 2.
