Art. 144.

1. Właściciel nie może sprzeciwić się zagrożeniom spowodowanym ruchem zakładu górniczego, który jest prowadzony zgodnie z ustawą. Może on jednak żądać naprawienia wyrządzonej tym ruchem szkody, na zasadach określonych ustawą.

2. Przepis ust. 1 stosuje się odpowiednio do innych podmiotów, których prawa majątkowe są zagrożone ruchem zakładu górniczego.

3. Jeżeli nie zachodzą okoliczności przewidziane w ust. 1 i 2, przedsiębiorca odpowiada za szkodę według zasad określonych w Kodeksie cywilnym.
