Art. 138. W razie stwierdzenia, że przedsiębiorca nie dokonał wpłaty opłaty w terminie albo dokonał wpłaty w wysokości innej niż należna, organ koncesyjny określa, w drodze decyzji, wysokość należnej opłaty, stosując stawkę obowiązującą w okresie rozliczeniowym, którego opłata dotyczy.
