3. W przypadkach określonych w przepisach wydanych na podstawie ust. 4 zaliczeń, o których mowa w ust. 1, dokonuje się także w oparciu o wyniki badań przeprowadzonych przez rzeczoznawcę do spraw ruchu zakładu górniczego oraz opinię tego rzeczoznawcy.
