Art. 5872.

§ 1. Kto wbrew obowiązkom wynikającym z art. 2192 § 3, art. 30071a

§ 3 albo art. 3821 § 3, doprowadza do tego, że zarząd nie zapewnia doradcy rady nadzorczej dostępu do dokumentów, nie udziela mu żądanych informacji, przekazuje je niezgodne ze stanem faktycznym, lub zataja dane wpływające w istotny sposób na treść tych informacji lub dokumentów

– podlega grzywnie nie niższej niż 20 000 złotych i nie wyższej niż 50 000 złotych albo karze ograniczenia wolności.

§ 2. Jeżeli sprawca działa nieumyślnie

– podlega grzywnie nie niższej niż 6000 złotych i nie wyższej niż 20 000 złotych.
