Art. 5849. Oświadczenie o przekształceniu przedsiębiorcy powinno zostać sporządzone w formie aktu notarialnego i określać co najmniej:

1) formę prawną spółki, w jaką zostaje przekształcony przedsiębiorca;

2) wysokość kapitału zakładowego albo kapitału akcyjnego;

3) zakres praw przyznanych osobiście przedsiębiorcy przekształcanemu jako wspólnikowi albo akcjonariuszowi spółki przekształconej, jeżeli przyznanie takich praw jest przewidziane;

4) nazwiska i imiona członków zarządu spółki przekształconej.
