§ 1. Wspólnicy łączącej się spółki osobowej odpowiadają na dotychczasowych zasadach, subsydiarnie wobec wierzycieli spółki, solidarnie ze spółką przejmującą albo spółką nowo zawiązaną, za zobowiązania spółki osobowej powstałe przed dniem połączenia, przez okres trzech lat licząc od tego dnia.
§ 2. Przepis art. 31 stosuje się odpowiednio.
