Art. 317.

§ 1. W przypadku stwierdzenia w zgłoszeniu braku usuwalnego, sąd rejestrowy wyznacza spółce w organizacji stosowny termin do jego usunięcia pod rygorem odmowy wpisu do rejestru.

§ 2. Sąd rejestrowy nie może odmówić wpisania spółki do rejestru z powodu drobnych uchybień, które nie naruszają interesu spółki oraz interesu publicznego, a nie mogą być usunięte bez poniesienia niewspółmiernie wysokich kosztów.
