§ 3. Jeżeli przedmiotem wkładu lub nabycia jest przedsiębiorstwo, do sprawozdania założycieli należy dołączyć sprawozdania finansowe dotyczące tego przedsiębiorstwa za okres ostatnich dwóch lat obrotowych. Jeżeli przedsiębiorstwo prowadzono przez okres krótszy niż dwa lata, sprawozdanie finansowe powinno obejmować cały okres działalności. Przepis art. 10¹ stosuje się odpowiednio.
