Art. 267.

§ 1. Sąd, orzekając o wyłączeniu, wyznacza termin, w ciągu którego wyłączonemu wspólnikowi ma być zapłacona cena przejęcia wraz z odsetkami, licząc od dnia doręczenia pozwu. Jeżeli w ciągu tego czasu kwota nie została zapłacona albo złożona do depozytu sądowego, orzeczenie o wyłączeniu staje się bezskuteczne.

§ 2. W przypadku gdy orzeczenie o wyłączeniu stało się bezskuteczne z przyczyn określonych w § 1, wspólnik bezskutecznie wyłączony ma prawo żądać od pozywających naprawienia szkody.
