Art. 11.

§ 1. Spółki kapitałowe w organizacji, o których mowa w art. 161, art. 30011 i art. 323, mogą we własnym imieniu nabywać prawa, w tym własność nieruchomości i inne prawa rzeczowe, zaciągać zobowiązania, pozywać i być pozywane.

§ 2. Do spółki kapitałowej w organizacji w sprawach nieuregulowanych w ustawie stosuje się odpowiednio przepisy dotyczące danej formy prawnej spółki po jej wpisie do rejestru.

§ 3. Firma spółki kapitałowej w organizacji powinna zawierać dodatkowe oznaczenie „w organizacji”.
