Art. 5. Kierownik urzędu stanu cywilnego, który dowiedział się o istnieniu okoliczności wyłączającej zawarcie zamierzonego małżeństwa, odmówi przyjęcia oświadczeń o wstąpieniu w związek małżeński lub wydania zaświadczenia, o którym mowa w art. 41, a w razie wątpliwości zwróci się do sądu o rozstrzygnięcie, czy małżeństwo może być zawarte.
