Art. 120. Jeżeli dziecko pozostaje pod opieką, do przysposobienia potrzebna jest zgoda opiekuna. Jednakże sąd opiekuńczy może, ze względu na szczególne okoliczności, orzec przysposobienie nawet mimo braku zgody opiekuna, jeżeli wymaga tego dobro dziecka.
