Art. 99.

§ 1. Pracownikowi przysługuje roszczenie o naprawienie szkody wyrządzonej przez pracodawcę wskutek niewydania w terminie lub wydania niewłaściwego świadectwa pracy.

§ 2. Odszkodowanie, o którym mowa w § 1, przysługuje w wysokości wynagrodzenia za czas pozostawania bez pracy z tego powodu, niedłuższy jednak niż 6 tygodni.

§ 3. (uchylony)

§ 4. Orzeczenie o odszkodowaniu w związku z wydaniem niewłaściwego świadectwa pracy stanowi podstawę do zmiany tego świadectwa.
