Art. 98610.

§ 1. Sąd albo referendarz sądowy wydaje postanowienie co do przybicia na posiedzeniu niejawnym w terminie tygodnia od dnia otrzymania protokołu z przebiegu przetargu oraz dokumentów niezbędnych do udzielenia przybicia. Przepis art. 988 § 2 stosuje się.

§ 2. Wysłuchania licytanta, który zaofiarował najwyższą cenę, oraz uczestników przetargu dokonuje się jedynie wtedy, gdy jest to konieczne dla wydania postanowienia co do przybicia.
