Art. 669. Sąd spadku wydaje postanowienie o stwierdzeniu nabycia spadku po przeprowadzeniu rozprawy, na którą wzywa wnioskodawcę oraz osoby mogące wchodzić w rachubę jako spadkobiercy testamentowi i jako spadkobiercy ustawowi zgodnie z kolejnością dziedziczenia. Spośród spadkobierców ustawowych wzywa się małżonka, zstępnych, osoby pozostające w stosunku przysposobienia, rodziców i rodzeństwo. Pozostałych spadkobierców ustawowych wzywa się, jeżeli są sądowi znani.
