Art. 45812. Niezależnie od wyniku sprawy sąd może obciążyć kosztami procesu w całości lub części stronę, która przed wytoczeniem powództwa zaniechała próby dobrowolnego rozwiązania sporu, uchyliła się od udziału w niej lub uczestniczyła w niej w złej wierze i przez to przyczyniła się do zbędnego wytoczenia powództwa lub wadliwego określenia przedmiotu sprawy.
