Art. 448.

§ 1. Jeżeli powództwo o unieważnienie małżeństwa wytacza prokurator, pozywa on oboje małżonków, a w wypadku śmierci jednego z nich – kuratora ustanowionego na miejsce zmarłego małżonka.

§ 2. Przepis paragrafu poprzedzającego stosuje się odpowiednio do powództwa prokuratora o ustalenie istnienia lub nieistnienia małżeństwa.
