Art. 405. Do wznowienia postępowania z przyczyn nieważności oraz na podstawie przewidzianej w art. 4011 właściwy jest sąd, który wydał zaskarżone orzeczenie, a jeżeli zaskarżono orzeczenia sądów różnych instancji, właściwy jest sąd instancji wyższej. Do wznowienia postępowania na innej podstawie właściwy jest sąd, który ostatnio orzekał co do istoty sprawy.
