Kodeks postępowania cywilnegoArt. 390. § 1

§ 1. Jeżeli przy rozpoznawaniu apelacji powstanie zagadnienie prawne budzące poważne wątpliwości, sąd może przedstawić to zagadnienie do rozstrzygnięcia Sądowi Najwyższemu, odraczając rozpoznanie sprawy. Sąd Najwyższy władny jest przejąć sprawę do rozpoznania albo przekazać zagadnienie do rozstrzygnięcia powiększonemu składowi tego Sądu.
