Art. 3431. Jeżeli po wydaniu wyroku zaocznego okaże się, że pozwany w chwili wniesienia pozwu nie miał zdolności sądowej, zdolności procesowej albo organu powołanego do jego reprezentowania, a braki te nie zostały usunięte w wyznaczonym terminie zgodnie z przepisami kodeksu, sąd z urzędu uchyla wyrok zaoczny i wydaje odpowiednie postanowienie.
