Art. 316.

§ 1. Po zamknięciu rozprawy sąd wydaje wyrok, biorąc za podstawę stan rzeczy istniejący w chwili zamknięcia rozprawy; w szczególności zasądzeniu roszczenia nie stoi na przeszkodzie okoliczność, że stało się ono wymagalne w toku sprawy.

§ 2. Rozprawa powinna być otwarta na nowo, jeżeli istotne okoliczności ujawniły się dopiero po jej zamknięciu.
