Art. 138.

§ 1. Jeżeli doręczający nie zastanie adresata w mieszkaniu, może doręczyć pismo sądowe dorosłemu domownikowi, a gdyby go nie było – administracji domu, dozorcy domu lub sołtysowi, jeżeli osoby te nie są przeciwnikami adresata w sprawie i podjęły się oddania mu pisma.

§ 2. Dla adresata, którego doręczający nie zastanie w miejscu pracy, można doręczyć pismo osobie upoważnionej do odbioru pism.
