Art. 1169.

§ 1. Strony mogą w umowie określić liczbę sędziów sądu polubownego (arbitrów).

§ 2. W braku takiego określenia powołuje się sąd polubowny w składzie trzech arbitrów.

§ 21. Jeżeli z powództwem występują albo pozwano dwie lub więcej osób, powołują one arbitra jednomyślnie, chyba że zapis na sąd polubowny stanowi inaczej.

§ 3. Postanowienia umowy przyznające jednej ze stron więcej uprawnień przy powołaniu sądu polubownego są bezskuteczne.
