Art. 1124.

§ 1. Zgłaszając w przepisanym czasie wniosek o zabezpieczenie kosztów, pozwany nie ma obowiązku składać wyjaśnień co do istoty sprawy przed rozstrzygnięciem tego wniosku.

§ 2. Sąd wyznaczy powodowi termin do złożenia kaucji.

§ 3. Po bezskutecznym upływie terminu sąd odrzuca pozew lub środek odwoławczy, orzekając o kosztach jak w przypadku cofnięcia pozwu.
