§ 1. Plan podziału sporządza komornik niezwłocznie po złożeniu na rachunek depozytowy Ministra Finansów sumy ulegającej podziałowi oraz po uprawomocnieniu się postanowienia w przedmiocie kosztów.

§ 2. Jeżeli egzekucja jest prowadzona z wierzytelności mających za przedmiot świadczenia bieżące, stosuje się odpowiednio przepisy art. 1029 § 1 i 3 oraz art. 1031.
