Art. 89.

§ 1. Organ administracji publicznej przeprowadzi, z urzędu lub na wniosek strony, w toku postępowania rozprawę, w każdym przypadku gdy zapewni to przyspieszenie lub uproszczenie postępowania lub gdy wymaga tego przepis prawa.

§ 2. Organ powinien przeprowadzić rozprawę, gdy zachodzi potrzeba uzgodnienia interesów stron oraz gdy jest to potrzebne dla wyjaśnienia sprawy przy udziale świadków lub biegłych albo w drodze oględzin.
