Art. 61a.

§ 1. Gdy żądanie, o którym mowa w art. 61, zostało wniesione przez osobę niebędącą stroną lub z innych uzasadnionych przyczyn postępowanie nie może być wszczęte, organ administracji publicznej wydaje postanowienie o odmowie wszczęcia postępowania. Przepis art. 61 § 5 stosuje się odpowiednio.

§ 2. Na postanowienie, o którym mowa w § 1, służy zażalenie.
