Art. 159.

§ 1. Organ administracji publicznej, właściwy w sprawie stwierdzenia nieważności decyzji, wstrzyma z urzędu lub na żądanie strony wykonanie decyzji, jeżeli zachodzi prawdopodobieństwo, że jest ona dotknięta jedną z wad wymienionych w art. 156 § 1.

§ 2. Na postanowienie o wstrzymaniu wykonania decyzji służy stronie zażalenie.
